Information Collection and Usage

Account Information:

Visitors to DramaTalk’s Services may provide personal information, such as a username, password, email address, phone number, full name, display name, pseudonym, and profile pictures, to create an account. This information may be used to verify your account and communicate with you. Your phone number may be used to send verification codes and other messages related to account management. While you can maintain a level of anonymity, remember that your posts, comments, and username are visible publicly by default.

Email Communications:

You may receive emails from us related to account management or updates. Administrative emails cannot be opted out of, but you can opt out of promotional emails via the provided link. We will never ask for your password or account information via email; if you receive such a request, please forward it to us.

Third Party Service Accounts:

You have the option to connect your Account with specific Third-Party Services. To facilitate this connection, you may need to provide us with your username or another user identifier for the Third-Party Service, and you may be prompted to log in to that service. Once you’ve completed the login steps, we will be granted a token that enables us to access your account on the Third-Party Service, which allows us to, for instance, publish your content to that service at your request. Please note that we do not receive or store your passwords for your Third-Party Service accounts. Furthermore, you can link your Facebook, Twitter, and other social media accounts to DramaTalk, granting us access to information from those accounts, such as your friends or contacts list. The data we obtain from these services typically depends on your settings or their privacy policies, so it’s important to review what these are.

Information from Third Party Services:

We may collaborate with Third Party Services that can supply details about you. For instance, this might involve your gender, provided you’ve shared this data with the Third Party Service and granted DramaTalk permission to retrieve it. If we acquire such information, we may utilize it to innovate new Services or to refine and enhance our existing offerings.When you link additional Third Party Services to your DramaTalk account, these services may disclose information about you to us. The specifics of what is shared are governed by their respective privacy policies.

Native Actions:

By standard settings, all sharing via the Services is open to the public, and any content you supply to us is disseminated for anyone to see. Material that is published and shared publicly is accessible to all, including search engine indexing. Furthermore, information shared openly might be replicated and disseminated across the internet, including via inherent actions or features of the Services like Sharing, Resharing, or forwarding. Essentially, DramaTalk operates as a public platform. Feel free to share remarkable content, but be aware that it can be challenging to entirely delete items from the internet once they have been shared or reshared multiple times.

Native Actions:

The Services enable you to engage in actions that are fundamental to our offerings, such as liking a post, commenting on a post, sharing a post, replying to a post, and so on. Liking, sharing, and replying are public activities; anyone can, for instance, view the “activities” section of a post to see who has liked, shared, or replied to it. We utilize data on these native actions to enhance the Services, create new offerings, and specifically to tailor your DramaTalk experience. This personalization may involve showing you new posts that align with your interests, delivering more accurate search results, and presenting you with advertisements that are more aligned with your preferences.When you share information or content, such as text, images, videos, GIFs, etc., as well as actions like shares, likes, replies, comments, etc. through the Services, consider carefully what you are revealing to the public.

Information About User Content:

Under certain circumstances, we may gather data related to the content you supply to the Services. For instance, we might collect details on whether the recipient has seen or replayed the content, along with any metadata that accompanies the content. If included within your images, we could also collect information detailing your camera model, camera settings, or EXIF data. This information is used to enhance the Services and to offer additional features and capabilities.

Camera and Photos:

Our Services may require access to your device’s camera and photos, but only after receiving your consent.

Usage Information:

Currently, whenever you engage with a website, mobile app, or other online service, certain data is typically generated and logged automatically. This holds true for our products as well. We gather insights on how individuals, including those with an Account, utilize the Services. This data may be captured in our log files with each interaction (i.e., request) made with the Services. We employ internal resources and third-party applications and services (such as Google Analytics, etc.) to collect and assess this information. Portions of this data may be linked to the Internet Protocol Address (“IP Address”) used to access the Services; some may be tied to your Account; and some may only be gathered and utilized in an aggregated format (as a statistical measure that doesn’t pinpoint you or your Account). We also log your IP Address when you create a post or take actions like commenting, sharing, etc. We may utilize this information about user engagement with the Services for various purposes related to enhancing, refining, safeguarding, and developing new Services, including but not limited to: offering personalized content to users; delivering targeted advertising; enhancing our search outcomes; identifying trending or popular content; combating spam, malware, identity theft, and ensuring the safety of our users and community; and for legal and safety reasons outlined in “Information Disclosed for Our Protection and the Protection of Others.” We apply information about your interactions with DramaTalk to customize your experience, protect both you and our community from harm, and to enhance DramaTalk for all its users.

Browser Information:

When you engage with the Services, we automatically receive and log data from your web browser, including details such as the type and version of your browser, the type of device you’re using, your operating system and its version, your language preferences, the website or service that directed you to the Services, the date and time of each interaction with the Services, your screen display details, and data from any cookies we’ve installed on your browser (as outlined below). Additionally, we occasionally identify if you’re using specific web browser extensions and retain this information in association with your Account. We utilize this browser-related information to refine and enhance the Services.

Mobile Device Information:

We might gather and retain data pertaining to your mobile device. Furthermore, we may request your phone number to facilitate the introduction of new products and to enhance the Services, for instance, by enabling multi-factor authentication for accessing your Account.

Cookies:

A cookie, referred to also as a web cookie, browser cookie, or HTTP cookie, is a segment of text that is stored by a user’s web browser. This data empowers ad networks to, among other functions, serve advertisements that they deem most relevant to you. Contacts Information:

Specific functionalities within the Services enable you to share your contact lists with us, facilitating connections with individuals within our Services who are also on those lists. For instance, you can transmit your mobile phone contact details to us via our mobile apps, which in turn enables us to present you with a list of those contacts who are using the Services, allowing you to “follow” them. Additionally, when you grant us access to your device’s phonebook, we may disclose information about you to other users whose device phonebooks contain your phone number.

Sharing of Information

Public Sharing:

As mentioned in the sections on “User Content” and “Native Actions,” the default setting is for content posted through the Services and many actions you take on the platform to be visible to the public. Given that this information can be viewed by anyone and may be indexed by search engines, you should exercise caution with what you disclose publicly, ensuring it is information you are comfortable sharing with everyone. Content you generate on DramaTalk is, by default, accessible to the public. This implies that it can be seen by anyone and may be indexed by search engines.

User Consent:

We may share or reveal your information as per your instructions, such as when you grant permission to a third-party web client or application to access your account.

Third Party Services:

The Services may feature links to third-party websites, include third-party integrations, or be a co-branded or third-party-branded service offered in collaboration with or by another company. By accessing these links, using third-party integrations, or utilizing co-branded or third-party-branded services, you may be directly providing information (including personal data) to the third party, to us, or to both. You may also opt to share information you provide to us, such as posts, with these Third-Party Services (for instance, by sharing posts on Twitter or Facebook). This is where our Privacy Policy ceases and their policies commence. Please ensure you are comfortable with the policies of any services you choose to link to your DramaTalk account. You acknowledge and agree that we are not liable for how those third parties collect or utilize your information. As a general rule, we advise you to review the privacy policies of any third-party websites or services you visit or use, including those with which you interact through our services. This Privacy Policy only governs the information we collect, and you are responsible for reading and understanding the privacy policies of those Third-Party Services.

Service Providers:

Occasionally, we may share certain stored information, such as IP addresses, with third parties known as “Agents” (which may include service providers, consultants, and other agents). This sharing is done to facilitate the operation of the Services, enhance their functionality, and develop new products and services. For instance, we may share information with service providers to combat spam, and consultants may need access to information to improve our processes and technology. These Agents are typically subject to confidentiality obligations and, unless we indicate otherwise, they are not permitted to use the information we share with them beyond what is necessary to assist us.

Business Transfers:

In certain situations, we may opt to purchase or sell business assets. During such transactions, user information is often a part of the assets being transferred. Moreover, if we, or substantially all of our assets, were acquired, or if we were to cease operations or enter bankruptcy, user information would likely be among the assets that would be acquired by a third party. User Requests:

Upon request, we will release information about your account if feasible.

Payment Providers:

When you opt to purchase Beans or engage in other payment-related transactions, we may share data with the appropriate payment provider to facilitate the transaction. For Bean transactions, we provide a transaction ID to help us identify you and credit your account with the correct amount of Beans after you have made the payment.

Other Third Parties:

Non-private or aggregated data may be shared with business partners.

Data Security

The privacy and security of your Account Information is safeguarded by a password. We may introduce extra security features, such as multi-factor authentication, in the future. It is essential to prevent unauthorized access to your Account and information by establishing a distinctive, secure, and protected password. Additionally, you should limit access to your computer and browser by logging out after you finish using your Account on the Services.

We implement suitable security measures to defend against unauthorized access or unauthorized modification, disclosure, or destruction of data. This includes conducting internal reviews of our data collection, storage, and processing practices, as well as implementing security measures that involve appropriate encryption and physical security to prevent unauthorized access to systems where personal data is stored.

We strive to protect your information, including your Account Information, to maintain its confidentiality. However, no security system is infallible. As robust as our security measures may be, we cannot guarantee the security of any information. Unauthorized access or use, hardware or software malfunctions, and other factors could potentially compromise the security of user information at any time.

Access to Your Information

Registered users can view most of the information linked to their Account by signing in to the Services and reviewing their Account Settings page. Both registered and unregistered users have the ability to access and remove cookies via their web browser’s settings.

DramaTalk Child Safety Standards and Community Guidelines

At DramaTalk, user safety and well-being are our top priorities. To maintain a secure and responsible live-streaming environment, we enforce comprehensive rules and guidelines for all users and streamers.

1. Prohibition of Child-Related Content and Services

DramaTalk does not allow any content related to children on its platform.

Our platform and services are exclusively for users aged 18 and above. Individuals under 18 are strictly prohibited from using DramaTalk.

2. Zero Tolerance for Child Exploitation and Abuse

DramaTalk has a strict zero-tolerance policy toward any form of child exploitation or abuse, including but not limited to:

Inappropriate Interactions: Targeted actions such as groping or caressing a child.

Child Grooming: Befriending a child online with the intent to facilitate sexual contact or exchange of explicit imagery.

Sexualization of Minors: Depictions, encouragement, or promotion of child sexual abuse or the portrayal of children in a sexually exploitative manner.

Sextortion: Threatening or blackmailing a child using intimate imagery.

Child Trafficking: Advertising or soliciting a child for commercial sexual exploitation.

Violations of these rules will result in immediate account suspension or termination, along with possible legal action. Content involving child sexual abuse materials will be reported to the National Center for Missing & Exploited Children (NCMEC) and other relevant authorities.

3. Age Verification and Usage Restrictions

Users must be at least 18 years old to create an account or participate in live-streaming activities.

Misrepresenting age during account registration will lead to suspension or termination of the account.

4. Content Moderation for Live Streams

To ensure a safe environment, all streamers and users must follow these guidelines:

Prohibited Content: Explicit material, harassment, bullying, or any content harmful to minors is strictly forbidden.

Mandatory Moderation: Streamers must actively moderate their streams to comply with platform rules.

5. Reporting Mechanisms

Users are encouraged to report suspicious or harmful activities.

Reporting Tools: Accessible within the app for flagging inappropriate behavior or content.

Prompt Response: Our moderation team will review reports and take immediate action.

6. Streamer Responsibilities

Streamers play a critical role in maintaining a safe and respectful platform. They are required to:

Ensure all content adheres to DramaTalk’s rules, including the prohibition of child-related material.

Actively manage and monitor their streams to maintain a positive and respectful environment.

7. Enforcement and Penalties

We rigorously enforce our community standards:

Content Removal: Any content that violates our guidelines will be promptly removed.

Account Penalties: Violations can result in temporary suspension or permanent bans.

Legal Action: Severe cases of child exploitation will be reported to law enforcement and child protection agencies.

8. Education and Awareness
DramaTalk is committed to fostering a culture of safety and awareness by:

Providing resources to help users and streamers recognize and prevent harmful behaviors.

Collaborating with child safety organizations to continually improve our standards.

By using DramaTalk, you confirm that you are at least 18 years old and agree to comply with these child safety standards and community guidelines. Together, we can create a safe, secure, and respectful community for everyone.

Guest User Data

Please be aware that if you access the app as a guest, the original guest data may be lost after switching or resetting your device. Therefore, we strongly recommend that you log in and register as soon as possible to bind your user account.

Account Deletion

To remove your Account and associated Data, send a request, including evidence of your authority over the Account. The necessary "proof of authority" will depend on the context but typically involves providing enough identification details to confirm that you are the Account’s rightful owner.

We retain your personal information only for the duration necessary for the legal grounds we rely on and as allowed by applicable law. You have the option to permanently delete your Account and Data at any time.

Upon deactivation of your Account, we take reasonable steps to ensure it is no longer visible within the App. Within a 28-day period, it’s possible to restore your Account if it was mistakenly or improperly deactivated. After 28 days, we commence the deletion of your personal information from our systems, unless:

  1. We are required by law to retain it (e.g., for accounting purposes if you made purchases within the App);
  2. We need to retain it to demonstrate compliance with legal requirements;
  3. There is an unresolved issue, claim, or dispute that necessitates keeping the information; or
  4. The information is necessary for our legitimate business interests, such as fraud prevention and enhancing user safety and security. For instance, retaining information to prevent a user banned for unsafe behavior or security incidents from creating a new account.

When DramaTalk employs machine learning, as in detecting and preventing fraudulent card transactions or spam communications on the App, we may need to retain personal information beyond the standard retention periods for the machine learning to function effectively. In such cases, we strive to minimize the personal information used, ensure it is securely isolated from other users’ personal information, and regularly review the retention period, deleting identifiable information when no longer necessary.

To prevent misuse of DramaTalk after a User’s profile or Account is terminated or deleted, we may, at our sole discretion, retain information deemed necessary to ensure the User does not violate our Terms and Conditions of Use by opening a new Account and to comply with all applicable laws and regulations.
